Many of these policies, particularly those purchased through a group plan, are covered by a federal law known as the Employee Retirement Income Security Act of 1974 (ERISA). If an insurance company wrongfully denies your claim or improperly terminates your benefits, you may be able to file a lawsuit against it in federal court under ERISA.
Most employees are entitled to benefits for work-related injuries and illnesses under the Pennsylvania Workers’ Compensation Act. You may be eligible for workers’ compensation for a wide range of injuries and illnesses, including those related to occupational exposures and repetitive stress injuries. Under this no-fault system, workers may qualify for coverage for medical treatment, lost wages, and disability benefits based on the severity of their injury and whether they will be able to return to work.
Although Pennsylvania is an “at-will” work state, where an employer can fire you for almost any reason, you cannot be fired for an illegal reason, such as your age, gender, race, disability status, national origin, or religion. Both federal and state law protect employees from wrongful termination and discrimination.
