Social Security Disability / SSDI Claims
If you are unable to work due to a disability, you may be eligible for Social Security disability benefits through the Social Security Administration (SSA). Depending on your specific circumstances, you may be able to apply for Social Security Disability Insurance (SSDI) and/or Supplemental Security Insurance (SSI). To successfully claim either SSDI or SSI, you will need to provide documentation of your medical or mental health condition, and how it limits your ability to work. Veterans Disability Compensation & Pension
Veterans of the U.S. Armed Forces may be eligible for benefits from Veterans Affairs (VA) if they have a service-connected disability. While the VA does not allow veterans to be represented by counsel when applying for benefits, you can schedule a free consultation for advice on filing for VA benefits. Long Term Disability Claims / ERISA Benefits
Long-term disability (LTD) is a type of insurance that provides monthly payments in the event that you are not able to work due to a disability. These benefits are often for 50% to 60% of your salary and may last for 24 months or to retirement age. Many insurance companies are reluctant to pay on these types of claims, and may unjustly deny or delay your claim. Bross & Frankel lawyers can file an appeal directly with the insurance company. If the appeal is denied, we can file a lawsuit against the insurance company in federal court [if the plan is covered by the Employee Retirement Income Security Act of 1974 (ERISA)], or in state court.
Workers Compensation Claims
The New Jersey Workers’ Compensation Law offers a no-fault system of insurance where employees who are injured or become ill as a result of their work can receive benefits. Under this law, an injured employee may be entitled to medical treatment, temporary disability, permanent partial disability, or permanent total disability. If a worker dies on the job, their survivors may be entitled to death benefits. Because workers’ compensation is a no-fault system, you do not have to prove your employer did something wrong in order to be awarded benefits. These cases can often be complex, with employers and/or their insurance companies denying or minimizing claims. We will advocate for you throughout the process, helping you file a claim and any necessary appeals.
Employment Law / Employment Discrimination
Both federal and New Jersey state prohibit workplace discrimination on the basis of age, gender, race, disability status, national origin, or religion.
