How We Can Help You
If you are unable to work due to a disability, you may be eligible for Social Security disability benefits through the Social Security Administration (SSA). Depending on your specific circumstances, you may be able to apply for Social Security Disability Insurance (SSDI) and/or Supplemental Security Insurance (SSI). To successfully claim either SSDI or SSI, you will need to provide documentation of your medical or mental health condition, and how it limits your ability to work. Our New Jersey disability attorneys can help you file an application and handle any appeals that you may need to file if your claim is denied.
Veterans of the U.S. Armed Forces may be eligible for benefits from Veterans Affairs (VA) if they have a service-connected disability. The VA offers a number of benefits, including disability benefits, a pension, and compensation for survivors. While the VA does not allow veterans to be represented by counsel when applying for benefits, you can schedule a free consultation at our Mt. Holly office for advice on filing for VA benefits. If your claim is denied or you receive a lower disability rating than you believe is fair, we can then file an appeal for you.
Long-term disability (LTD) is a type of insurance that provides monthly payments in the event that you are not able to work due to a disability. These benefits are often for 50% to 60% of your salary and may last for 24 months or to retirement age. Many insurance companies are reluctant to pay on these types of claims, and may unjustly deny or delay your claim. The lawyers at our Mt. Holly office can file an appeal directly with the insurance company. If the appeal is denied, we can file a lawsuit against the insurance company in federal court [if the plan is covered by the Employee Retirement Income Security Act of 1974 (ERISA)], or in state court.
The New Jersey Workers’ Compensation Law offers a no-fault system of insurance where employees who are injured or become ill as a result of their work can receive benefits. Under this law, an injured employee may be entitled to medical treatment, temporary disability, permanent partial disability, or permanent total disability. If a worker dies on the job, their survivors may be entitled to death benefits. Because workers’ compensation is a no-fault system, you do not have to prove your employer did something wrong in order to be awarded benefits. These cases can often be complex, with employers and/or their insurance companies denying or minimizing claims. We will advocate for you throughout the process, helping you file a claim and any necessary appeals.
Both federal and New Jersey state prohibit workplace discrimination on the basis of age, gender, race, disability status, national origin, or religion. Despite these laws, employers often engage in illegal conduct, such as firing an employee on the basis of age, tolerating sexual harassment, or retaliating against employees who speak up about harassment or discrimination. Our firm represents employees who have been subjected to discrimination, harassment, and other types of illegal conduct at work. We will fight for your right to compensation.
