There are many challenges that people with disabilities may face, from stigma to lack of accessibility to financial struggles. At Bross & Frankel, we are fierce advocates for people with disabilities. Our practice is devoted to helping people with disabilities get benefits or other forms of compensation that they are entitled to under the law or through their insurance.
From our Princeton office, we represent New Jersey residents who need assistance filing for veterans benefits, Social Security disability benefits, long term disability benefits, and more. With substantial experience in the field of disability benefits — including with the Social Security Administration itself — our team understands the nuances of the complex laws that govern these programs. We put our knowledge and skill to work for you.
Beyond disability benefits, we represent individuals who have been hurt or developed an illness related to work. We also advocate for people who have suffered workplace harassment or discrimination. In each of our cases, our goal is to help our clients achieve the best possible outcome for their claim.
What We Do
The Social Security Administration (SSA) offers two types of benefits for people with disabilities: Social Security Income (SSI) and Social Security Disability Insurance (SSDI). A person may qualify for one or both types of benefits, depending on their specific situation. The process of applying may be challenging, with many layers of red tape and bureaucracy. Our law firm will assist you with the process, from an initial application to a final resolution.
For military veterans, benefits may be available through the Veterans Administration (VA), including for those service members who suffered a service-connected disability. While veterans cannot be represented by counsel when they first apply for benefits, Bross & Frankel offers free consultations to vets who would like advice on how to start this process. This includes providing information about what benefits you may be entitled to under federal law. If a dispute over your VA benefits arises, such as over your disability rating, we will advocate for you and help you get the benefits that you deserve.
Long-term disability (LTD) insurance policies can provide financial security in the event that you are unable to work due to disability. In most cases, these policies pay as much as 50 to 60% of your monthly salary while you cannot work. Unfortunately, insurers often look for ways to minimize the amount of LTD benefits paid — or to deny claims entirely. Our team of Princeton, NJ disability attorneys can analyze your policy, help you file for benefits, monitor your claim, and file an appeal or lawsuit as necessary. For policies covered by the Employee Retirement Income Security Act of 1974 (ERISA), this may include filing a federal lawsuit to enforce your rights under your policy.
Workers’ compensation is a no-fault system of insurance that most employers are required to purchase under the New Jersey Workers’ Compensation Law. If you are injured at work or develop an occupation disease, you may be able to obtain workers’ comp benefits, including medical treatment and financial compensation for your lost wages and disability. The amount of your benefits will depend on a number of factors, including the nature and extent of your injury. If your employer or their insurance carrier challenges your workers’ compensation claim, we will fight for your right to benefits under New Jersey law.
Employers in New Jersey can generally terminate an employee for any reason — unless the underlying reason is illegal. Under both state and federal law, employers cannot fire or discriminate against employees on the basis of their membership in a protected class (including age, race, national origin, gender, and disability status). If your employer has fired you, discriminated against you, or you have been subject to workplace harassment, you may be able to file a claim with the New Jersey Civil Rights Commission or the Equal Employment Opportunity Commission. Bross & Frankel will work with you to advocate for your rights throughout the process, including filing a lawsuit against your employer to help you achieve justice.
