If you live with a disability, then you are probably all-too-familiar with the challenges that come with a physical or mental health diagnosis. From everyday difficulties to challenges with work, there are myriad ways that having a disability can make your life harder. If you cannot work because of your disability, you may be entitled to benefits.
At Bross & Frankel, we are devoted to helping people with disabilities get the benefits that they deserve, whether through their insurance policy or through a government program. With more than 90 years of combined experience, we have the knowledge and the skill to help you through the process. From our office in Cherry Hill, we represent individuals throughout New Jersey who need assistance with a variety of claims related to disability benefits.
In addition, we assist people who have been hurt at work or who have developed occupational diseases with their workers’ compensation claims. Our team of legal professionals also represents people whose employers have treated them unfairly in violation of state or federal law. Whether you have experienced discrimination, harassment, or another form or wrongful conduct, we will fight for your right to justice.
What We Do
Americans who are unable to work due to a disability may be eligible for benefits through the Social Security Administration (SSA). Social Security Disability Insurance (SSDI) and Supplemental Security Income (SSI) benefits are often crucial in providing necessary financial support. The process of applying can often be overwhelming. Our firm can assist you throughout the process, from the initial application to representing you in an appeal and/or hearing.
Individuals who have served in our military may be eligible for certain benefits through the Veterans Administration (VA), including disability benefits for veterans who have suffered service-connected disabilities. Although the VA does not permit applicants to have legal representation during the initial application period, our Cherry Hill disability benefits attorneys will counsel you on the process and what benefits you may be eligible for, free of charge. If a dispute arises over your disability rating or if your benefits are denied, we can represent you on these and other matters before the VA.
Long-term disability insurance (LTD) is a way to ensure financial security in the event that you cannot work due to a disability that lasts for an extended period of time. This type of policy typically pays you between 50 and 60% of your salary each month. Unfortunately, insurers often look for reasons to deny claims, minimize the benefit amount, or even to terminate benefits early. Our firm will advocate for you with the insurance company, which may include filing a federal lawsuit for policies that are governed by the Employee Retirement Income Security Act of 1974 (ERISA).
Under the New Jersey Workers’ Compensation law, most employers are required to purchase workers’ compensation insurance. This policy will then provide medical treatment, lost wages, and disability benefits in the event that you are injured at work or develop an occupational disease. Workers’ comp is no-fault, which means you do not have to prove that your employer did something wrong in order to qualify for benefits. However, your employer or their insurer may still fight your claim. Bross & Frankel will advocate for you to receive the full amount of benefits that you are entitled to under the law.
New Jersey is an “at-will” state, which means that unless you have a contract or are a member of a union, your employer can terminate you for any reason – as long as that reason is not illegal. If your employer fires you, discriminates against you, or you are subjected to workplace harassment because of your membership in a protected class, then you may be able to file a lawsuit against them. Under state and federal law, discrimination on the basis of race, age, disability, sex, religion, color, genetic information, and national origin is forbidden. Our law firm represents clients who have been wrongfully terminated, discriminated against, or harassed in violation of these laws.
